General Terms and Conditions (GTC)

  1. Scope of application These general terms and conditions apply to all orders placed by consumers via our online shop.

For the purposes of these terms and conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity. A business is any natural or legal person or partnership with legal capacity that, when entering into a legal transaction, acts in the exercise of its commercial or independent professional activity.

  1. Contracting parties, conclusion of contract, correction options The purchase contract is concluded with smartpaws GmbH.

By placing products in our online shop, we are making a binding offer to conclude a contract for these items. You can initially place products in your shopping cart without obligation and correct your entries at any time before submitting your binding order. The correction tools provided and explained in the ordering process are available for this purpose. The contract is concluded when you accept the offer for the items in your shopping cart by clicking the order button. You will receive an order confirmation by email immediately after submitting your order.

  1. Contract Language and Storage of the Contract Text: The contract languages ​​are German and English. We store the contract text. You will receive the order details and our terms and conditions in text form. You can view the contract text via your customer account.

  2. Delivery conditions: We deliver free of charge within Germany.

Delivery is exclusively via shipping. Self-collection is not possible. Deliveries to parcel lockers are also excluded.

  1. Payment methods The following payment methods are available:

  • Credit card: Your card details will be transmitted when you place your order. Your card will be charged automatically after verification.

  • Klarna PayNow Direct Debit: After a successful credit check, you grant Klarna a SEPA mandate. The debit will be processed after shipment.

  • PayPal / PayPal Express: You will be redirected to PayPal to confirm the payment. Your payment will be processed immediately after ordering.

  • Apple Pay / Google Pay: Payment via the respective wallet after authentication and confirmation. The charge is processed immediately after order completion.

For payment processing via third-party providers, their terms and conditions and privacy policies also apply.

  1. Retention of title: The goods remain our property until full payment has been received.

  2. Damage in transit: In case of obvious damage in transit, please report this immediately to the delivery driver and contact us without delay. Failure to report the damage does not affect your statutory rights, but it helps us to pursue our own claims.

  3. Warranty and guarantees : The statutory warranty rights apply.

For used goods: If a defect occurs after one year from delivery, claims for defects are excluded. Within one year, defects can be claimed within the statutory period (2 years). Exceptions apply to damage resulting from:

  • Injury to life, body or health,

  • Intentional or grossly negligent conduct,

  • Breach of essential contractual obligations (cardinal obligations),

  • Assumption of a guarantee,

  • or if the product liability law applies.

  1. Liability Our liability is unlimited:

  • in case of injury to life, body or health,

  • in cases of intent or gross negligence,

  • in case of assumed warranty,

  • or within the scope of the Product Liability Act.

In cases of slight negligence in the breach of essential contractual obligations (cardinal obligations), we are only liable for the typical, foreseeable damage. In all other cases, liability is excluded.

  1. Code of Conduct We have committed ourselves to the following codes:

  1. Dispute Resolution: The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/ . We do not participate in dispute resolution proceedings before a consumer arbitration board.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods.

You can use the model cancellation form, but this is not mandatory. Sending your notification in time is sufficient to meet the deadline.

Consequences of cancellation: We will refund all payments received, including delivery costs (excluding special delivery methods), within 14 days of receiving your cancellation notice. The refund will be issued via the same payment method unless otherwise agreed.

We may refuse to issue a refund until we have received the goods back or you have provided proof of return.

The goods must be returned to us within 14 days of cancellation. You bear the direct costs of return shipping. Any loss in value will only be compensated if it is due to handling beyond what is necessary to ascertain the nature, characteristics, and functioning of the goods.
