Terms and Conditions

Scope of Application These General Terms and Conditions apply to all orders placed by consumers via our online shop.

For the purpose of these GTC, a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

Contractual Partner, Conclusion of Contract, Correction Options The purchase contract is concluded with smartpaws GmbH.

By placing products in our online shop, we make a binding offer to conclude a contract for these items. You can initially place products in the shopping cart without obligation and correct your entries at any time before submitting your binding order. The correction aids provided and explained during the order process are available to you for this purpose. The contract is concluded when you accept the offer for the items contained in the shopping cart by clicking the order button. Immediately after sending your order, you will receive a confirmation by e-mail.

Contract Language and Storage of the Contract Text The contract languages are German and English. We store the contract text. You will receive the order data and our GTC in text form. You can view the contract text via your customer account.
Delivery Conditions We deliver free of charge within Germany.

Delivery is exclusively by shipping. Self-collection is not possible. Deliveries to packing stations are also excluded.

Payment Methods The following payment methods are available:

Credit card: Your card data will be transmitted when the order is placed. After legitimation, the charge will be made automatically.
Klarna PayNow Direct Debit: After a successful credit check, you issue a SEPA mandate to Klarna. The charge will be made after shipping.
PayPal / PayPal Express: You will be redirected to PayPal and confirm the payment there. The charge will be made immediately after the order.
Apple Pay / Google Pay: Payment via the respective wallet after authentication and confirmation. The charge will be made directly after the order is completed.

For payment processing via third-party providers, their GTC and data protection policies also apply.

Retention of Title: The goods remain our property until full payment.
Transport Damage: In the event of obvious transport damage, we ask you to report it immediately to the delivery person and contact us without delay. Failure to report does not affect your statutory rights but helps us enforce our own claims.
Warranty and Guarantees The statutory liability for defects applies.

For used goods: If a defect occurs after one year from delivery, claims for defects are excluded. Within one year, defects can be asserted within the statutory period (2 years). Exceptions apply in the event of damage resulting from:

Injury to life, body or health,
Intent or gross negligence,
Breach of essential contractual obligations (cardinal obligations),
Assumption of a guarantee,
or if the Product Liability Act applies.

Liability Our liability is unlimited:

for injury to life, body or health,
for intent or gross negligence,
for assumed guarantees,
or within the scope of the Product Liability Act.

In the event of slight negligence in the breach of essential contractual obligations (cardinal obligations), we are only liable for the typical, foreseeable damage. In all other cases, liability is excluded.

Dispute Resolution The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. We do not participate in dispute resolution proceedings before a consumer arbitration board.

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason. The period begins on the day on which you or a third party named by you received the goods.

You can use the sample withdrawal form, but this is not mandatory. To meet the deadline, it is sufficient to send your notification in good time.

Consequences of withdrawal: We will refund all payments received, including delivery costs (excluding special delivery types), within 14 days from the date of receipt of your declaration of withdrawal. The refund will be made using the same payment method, unless otherwise agreed.

We may refuse the refund until we have received the goods back or you have provided proof of return.

The goods must be returned to us within 14 days of withdrawal. You bear the direct costs of returning the goods. Any loss in value is only to be compensated if it is due to handling that was not necessary for checking the quality, characteristics and functioning.
